Conditions Générales d’Utilisation – Thérapeutes
1. Objet
Ces conditions encadrent l’utilisation de la plateforme Sghartoon par les thérapeutes (profil, visibilité, réservation, paiement, outils, jeux, télé-suivi).
2. Inscription, Vérifications & Compte
- Fournir des informations exactes (identité, diplômes, licence/carte pro, zones d’intervention) et les maintenir à jour.
- Transmettre les justificatifs requis (CIN, diplôme/carte pro) pour vérification (KYC/AML si nécessaire).
- Le compte est personnel, non transférable et protégé par mot de passe.
3. Abonnement Thérapeute (Payant) & Indépendance
- Tarif standard : 30 TND/mois (ou équivalent local), payable d’avance sur la plateforme.
- Fonctionnalités payantes : visiothérapie en ligne, jeux thérapeutiques hors ligne & multijoueur, outils avancés (gestion des patients, télé-diagnostic, suivi, visibilité prioritaire).
- Indépendance : l’abonnement est dû même sans ventes via Sghartoon. Aucun minimum de leads n’est garanti.
3 bis. Offre Freemium, Fonctionnalités Gratuites & Fair Use
- Gratuit : calendrier, visibilité de base, prise de rendez-vous, accès aux résultats déjà partagés.
- Fair use : Sghartoon peut définir des quotas raisonnables (ex. minutes de visio, stockage, nombre de patients actifs) et limiter temporairement le service en cas d’usage excessif.
- Sghartoon peut modifier la liste des fonctionnalités/quotas avec un préavis de 30 jours (in-app/email).
3 ter. Renouvellement, Upgrade/Downgrade & Impayés
- Abonnement mensuel à renouvellement tacite jusqu’à résiliation avant échéance.
- Upgrade : prorata immédiat ; Downgrade : effet à la prochaine échéance.
- En cas d’échec de paiement, Sghartoon peut relancer et suspendre l’accès payant jusqu’à régularisation.
- Changement de tarif possible avec préavis de 30 jours.
4. Early Adopter
- Accès gratuit aux fonctionnalités payantes pendant 12 mois dès l’activation.
- À l’issue, bascule automatique vers l’abonnement payant, sauf résiliation écrite préalable.
- La commission de 15 % reste due sur toutes les ventes pendant la période Early Adopter.
5. Commission cédée à Sghartoon & Prix de Référence
- Le thérapeute cède contractuellement à Sghartoon une commission calculée sur le prix de la séance TTC qu’il a lui-même défini.
- Taux de commission :
- 5 % pour les paiements locaux
- 15 % pour les paiements internationaux
- Cette commission est destinée à couvrir notamment :
- les frais de paiement et d’encaissement,
- l’infrastructure technique et l’hébergement,
- les outils de gestion, de suivi et de visiothérapie,
- les actions marketing et la mise en relation avec les parents.
- Le thérapeute reste libre de fixer son Prix de Référence Thérapeute (prix public TTC), qu’il s’engage à maintenir à jour sur la plateforme.
- Les paiements des parents peuvent transiter par Sghartoon ou par un prestataire de paiement agréé ; la commission convenue est alors automatiquement appliquée.
6. Non-contournement & Propriété des Clients
- Interdiction de détourner un client acquis via Sghartoon vers un paiement direct hors plateforme pour éviter la commission.
- Durée : pendant l’utilisation et 12 mois après la cessation d’utilisation.
- En cas de contournement, Sghartoon peut réclamer la commission contractuelle et/ou résilier le compte.
7. Formats, Prix & Promotions
- Sghartoon peut proposer des formats (séance, pack, abonnement) et promotions sans réduire le net du thérapeute en-dessous du prix convenu après commission.
- Le thérapeute s’engage à ne pas afficher hors plateforme des prix anormalement bas visant à contourner la plateforme.
8. Qualité, Ponctualité, Enregistrements
- Respect des créneaux, standards de qualité, environnement adapté, connexion stable, caméra/micro fonctionnels.
- Enregistrement des séances interdit sans consentement écrit de toutes les parties.
- Annulations tardives/no-shows récurrents : déclassement, suspension ou résiliation.
8 bis. Avis, Classement & Visibilité
- Les parents peuvent noter/commenter ; Sghartoon peut modérer (contenus illicites, faux avis).
- Le classement dépend de multiples signaux (qualité, retours, no-shows, réactivité). Sghartoon peut l’ajuster à sa discrétion.
- Aucune garantie de visibilité ni de leads.
9. Facturation, Payouts & Réserve
- Reversement : sous 7 jours ouvrés après tenue effective de la séance.
- Seuil de virement : possibilité de grouper jusqu’à un minimum (ex. 50 TND).
- Réserve de sécurité : jusqu’à 10 % retenus pendant 30 jours pour couvrir remboursements/chargebacks.
- Compensation : Sghartoon peut compenser toute somme due par le thérapeute avec les montants à reverser.
9 bis. Remboursements, Litiges & Chargebacks
- Si remboursement dû à un motif imputable au thérapeute (annulation tardive, no-show), le montant est déduit des reversements suivants.
- En cas de chargeback, le compte peut être gelé; Sghartoon peut contester l’opposition et facturer des frais de traitement si infondée.
9 ter. Conformité & Assurance
- Le thérapeute garantit détenir l’agrément/autorisation d’exercer et une assurance RC professionnelle valide.
- Respect des lois (protection de l’enfance, signalements obligatoires, éthique pro).
- Le thérapeute reste responsable de ses obligations fiscales/sociales.
10. Données, Confidentialité & DPA “Light”
- Les parties agissent en responsables de traitement indépendants pour leurs finalités respectives.
- Sghartoon peut recourir à des sous-traitants listés sur son site ; mesures de sécurité adaptées ; notification d’incident sous 72h lorsqu’applicable.
- Traitement conforme à la Politique de Confidentialité et à la Politique Cookies.
- À la résiliation, possibilité de demander un export des données disponibles ; suppression ensuite sauf obligations légales.
11. Suspension & Résiliation
- Suspension en cas d’impayé, fraude, abus, contournement, violation répétée des CGU.
- Résiliation après mise en demeure restée infructueuse ; effets précisés à l’article 12 ter.
12. Limitation de Responsabilité & Indemnisation
- La responsabilité globale de Sghartoon est plafonnée aux frais/commissions versés par le thérapeute sur les 6 derniers mois.
- Le thérapeute indemnise Sghartoon contre toute réclamation de tiers liée à ses prestations.
12 ter. Effets de la Résiliation
- Les séances déjà réservées sont honorées ou remboursées selon la politique parent ; les montants correspondants peuvent être retenus/compensés.
- Export des données sur demande ; suppression ensuite (sauf obligations légales). La clause de non-contournement survit 12 mois.
13. Force Majeure
Sghartoon n’est pas responsable en cas de force majeure (pannes réseau, catastrophes…). Les séances peuvent être reprogrammées.
13 bis. Support & SLA
- Support in-app ou par email : support@sghartoon.com.
- Objectif de réponse : 2 jours ouvrés. Preuves : logs système (réservations, connexions, crédits).
14. Modification & Loi applicable
- CGU susceptibles d’évoluer avec un préavis de 30 jours (in-app/email). L’usage continu vaut acceptation.
- Droit tunisien – tribunaux compétents de Tunis.
Utilisation des données Google (Google User Data)
L’application Sghartoon Thérapeute utilise certains services Google afin de faciliter l’authentification des utilisateurs et, lorsque l’option est activée, la gestion du calendrier des séances.
Données Google auxquelles l’application accède
- Adresse e-mail associée au compte Google
- Nom et prénom du compte Google
- Identifiant unique du compte Google
- Données de calendrier Google (uniquement si la synchronisation est activée par l’utilisateur)
Finalité de l’utilisation des données
Les données Google sont utilisées exclusivement pour :
- L’authentification sécurisée via Google Sign-In
- L’identification du compte thérapeute sur la plateforme
- La synchronisation optionnelle des séances avec Google Calendar
Stockage et sécurité des données
Les données sont stockées de manière sécurisée sur les serveurs de Sghartoon ou chez des prestataires certifiés, avec des mesures techniques et organisationnelles adaptées pour prévenir tout accès non autorisé.
Partage des données
Les données Google ne sont ni vendues, ni louées, ni partagées avec des tiers à des fins commerciales. Elles ne sont accessibles qu’aux services strictement nécessaires au fonctionnement de l’application.
Durée de conservation
Les données sont conservées tant que le compte utilisateur est actif. L’utilisateur peut demander la suppression de ses données à tout moment.
Conformité Google
Sghartoon respecte la Google API Services User Data Policy, y compris les exigences de limitation d’utilisation des données (Limited Use).

1. Purpose
These terms govern therapists’ use of the Sghartoon platform (profile, visibility, booking, payments, tools, games, tele-follow-up).
2. Sign-Up, Checks & Account
- Provide accurate information (identity, diplomas, license, coverage areas) and keep it updated.
- Submit required proofs (ID, diploma/pro license) for verification (KYC/AML where applicable).
- Personal, non-transferable, password-protected account.
3. Paid Subscription & Independence
- Standard fee: 30 TND/month (or local equivalent), prepaid on the platform.
- Paid features: online therapy, offline/multiplayer therapeutic games, advanced tools (patient management, tele-diagnosis, follow-up, priority visibility).
- Independence: the fee is due even with zero sales through Sghartoon. No leads are guaranteed.
3 bis. Freemium Offer, Free Features & Fair Use
- Free: calendar, basic visibility, appointment booking, access to results already shared.
- Fair use: Sghartoon may set reasonable quotas (video minutes, storage, active patients) and throttle temporarily in case of excessive use.
- Features/quotas may change with 30-day prior notice (in-app/email).
3 ter. Renewal, Up/Downgrade & Non-Payment
- Monthly subscription with automatic renewal until cancellation before the due date.
- Upgrade: immediate pro-rata; Downgrade: takes effect at next billing cycle.
- On payment failure, Sghartoon may dunn and suspend paid access until resolved.
- Price changes with 30-day notice.
4. Early Adopter
- Free access to paid features for 12 months from activation.
- Then auto-switch to paid plan unless prior written termination.
- 15% commission remains due on all sales during Early Adopter.
5. Commission Assigned to Sghartoon & Reference Price
- The therapist contractually assigns to Sghartoon a commission calculated on the session price including taxes set by the therapist.
- Commission rates:
- 5% for local payments
- 15% for international payments
- This commission is intended to cover, among others:
- payment processing and collection costs,
- technical infrastructure and hosting,
- therapy tools, follow-up and video sessions,
- marketing activities and parent acquisition.
- The therapist remains free to define and update their Therapist Reference Price (public price incl. tax).
- Parent payments may be processed via Sghartoon or approved payment providers, and the agreed commission is applied accordingly.
6. Non-Circumvention & Client Ownership
- No redirecting Sghartoon clients to off-platform payments to avoid commission.
- Duration: during use and for 12 months after termination.
- In case of circumvention, Sghartoon may claim the contractual commission and/or terminate the account.
7. Formats, Pricing & Promotions
- Sghartoon may offer formats (session, pack, subscription) and promotions without reducing the therapist’s net below the agreed post-commission price.
- Therapist shall not advertise off-platform prices intended to undercut the platform.
8. Quality, Punctuality & Recording
- Honor time slots, maintain quality standards, ensure adequate environment, stable connection, working camera/microphone.
- Recording sessions is prohibited without all parties’ written consent.
- Repeated late cancellations/no-shows: ranking downgrade, suspension or termination.
8 bis. Reviews, Ranking & Visibility
- Parents may rate/review; Sghartoon may moderate (illegal content, fake reviews).
- Ranking depends on multiple signals (quality, feedback, no-shows, responsiveness) and may be adjusted at Sghartoon’s discretion.
- No guarantee of visibility or leads.
9. Invoicing, Payouts & Reserve
- Payout: within 7 business days after the session is performed.
- Minimum payout threshold: Sghartoon may batch payouts up to a minimum (e.g., 50 TND).
- Security reserve: up to 10% retained for 30 days to cover refunds/chargebacks.
- Set-off: Sghartoon may offset any amounts owed by the therapist against payouts.
9 bis. Refunds, Disputes & Chargebacks
- If a refund is due for a reason attributable to the therapist (late cancellation, no-show), the amount is deducted from subsequent payouts.
- On chargeback, the account may be frozen; Sghartoon may dispute the chargeback and charge processing fees if unfounded.
9 ter. Compliance & Insurance
- Therapist warrants to hold the required license/authorization and valid professional liability insurance.
- Compliance with laws (child protection, mandatory reporting, professional ethics).
- Therapist remains responsible for taxes/social contributions.
10. Data, Privacy & Light DPA
- The parties act as independent controllers for their respective purposes.
- Sghartoon may use sub-processors listed on its site; appropriate security; incident notice within 72h where applicable.
- Processing per our Privacy Policy and Cookie Policy.
- Upon termination, therapist may request a data export; deletion then follows (subject to legal retention).
11. Suspension & Termination
- Suspension for non-payment, fraud, abuse, circumvention, repeated breaches.
- Termination after notice remains unremedied; effects per clause 12 ter.
12. Liability Cap & Indemnity
- Sghartoon’s aggregate liability is capped at the fees/commissions paid by the therapist in the last 6 months.
- Therapist shall indemnify Sghartoon against third-party claims related to therapist’s services.
12 ter. Effects of Termination
- Booked sessions are fulfilled or refunded per parent policy; corresponding amounts may be withheld/set-off.
- Data export on request; deletion afterwards (subject to law). Non-circumvention survives 12 months.
13. Force Majeure
Sghartoon is not liable in case of force majeure (network outages, disasters…). Sessions may be rescheduled.
13 bis. Support & SLA
- Support in-app or via support@sghartoon.com.
- Target response time: 2 business days. Evidence: system logs (bookings, connections, credits).
14. Changes & Governing Law
- Terms may change with 30-day notice (in-app/email). Continued use constitutes acceptance.
- Tunisian law — courts of Tunis.
Google User Data
The Sghartoon Therapist application uses certain Google services to enable secure authentication and, when enabled by the user, session scheduling through Google Calendar.
Data accessed
- Email address
- Full name
- Google account unique identifier
- Google Calendar data (only if calendar synchronization is enabled)
How the data is used
- Secure authentication via Google Sign-In
- User account identification
- Optional synchronization of therapy sessions with Google Calendar
Data storage and protection
Data is securely stored using appropriate technical and organizational safeguards and is accessible only to authorized services required for application functionality.
Data sharing
Google user data is not sold, rented, or shared with third parties for advertising or commercial purposes.
Retention period
Data is retained for as long as the user account remains active. Users may request data deletion at any time.
Google API compliance
Sghartoon complies with the Google API Services User Data Policy, including the Limited Use requirements.
By ticking “I agree”, you accept these terms.

1. الهدف
تنظّم هذه الشروط استخدام المعالجين لمنصّة سغارطون (الملف، الظهور، الحجز، المدفوعات، الأدوات، الألعاب، المتابعة عن بُعد).
2. التسجيل والتحقّق والحساب
- تقديم معلومات دقيقة (الهوية، الشهادات، الترخيص المهني، مناطق العمل) وتحديثها.
- إرسال المستندات المطلوبة للتحقّق (بطاقة الهوية، الشهادة/الترخيص)، وإجراءات KYC/AML عند الاقتضاء.
- الحساب شخصي وغير قابل للتحويل ومحمي بكلمة مرور.
3. الاشتراك المدفوع والاستقلالية
- الرسوم القياسية: 30 دينار/شهر (أو ما يعادلها)، تُدفع مسبقًا عبر المنصّة.
- ميزات مدفوعة: العلاج عبر الفيديو، ألعاب علاجية أوفلاين/متعددة اللاعبين، أدوات متقدمة (إدارة المرضى، التشخيص عن بُعد، المتابعة، أولوية الظهور).
- الاستقلالية: الاشتراك مستحق حتى دون مبيعات عبر سغارطون. لا ضمان لعدد محدد من العملاء.
3 مكرر. عرض فريميوم، الميزات المجانية والاستخدام العادل
- مجاني: التقويم، الظهور الأساسي، حجز المواعيد، الوصول إلى النتائج المشتركة مسبقًا.
- استخدام عادل: يجوز لسغارطون تحديد حصص معقولة (دقائق فيديو، تخزين، عدد مرضى نشطين) وتقييد الخدمة مؤقتًا عند الإفراط.
- يجوز تحديث الميزات/الحصص بإشعار 30 يومًا (داخل التطبيق/البريد).
3 ثالثًا. التجديد والترقية/الخفض والتخلّف عن السداد
- اشتراك شهري مع تجديد تلقائي حتى الإلغاء قبل تاريخ الاستحقاق.
- الترقية: احتساب فوري نسبي؛ الخفض: يسري من دورة الفوترة التالية.
- عند فشل الدفع، يجوز لسغارطون القيام بالتذكير وتعليق الميزات المدفوعة حتى التسوية.
- يجوز تعديل الأسعار بإشعار 30 يومًا.
4. المتبنّي المبكر
- وصول مجاني للميزات المدفوعة لمدة 12 شهرًا من التفعيل.
- ثم يتحوّل تلقائيًا إلى اشتراك مدفوع ما لم يتم الإنهاء كتابيًا مسبقًا.
- تُطبّق عمولة 15% على جميع المبيعات خلال هذه الفترة.
5. التنازل عن العمولة لصالح سغارطون والسعر المرجعي
- يتنازل المعالج تعاقديًا لصالح سغارطون عن عمولة تُحتسب على سعر الجلسة شامل الضرائب الذي يحدده المعالج بنفسه.
- نِسَب العمولة:
- 5% للمدفوعات المحلية
- 15% للمدفوعات الدولية
- تُخصّص هذه العمولة لتغطية:
- تكاليف الدفع والتحصيل،
- البنية التحتية التقنية والاستضافة،
- أدوات العلاج والمتابعة والجلسات عن بُعد،
- أنشطة التسويق وربط المعالج بالأولياء.
- يبقى المعالج حرًّا في تحديد السعر المرجعي (السعر العام شامل الضرائب) مع الالتزام بتحديثه على المنصّة.
- يمكن أن تتم مدفوعات الأولياء عبر سغارطون أو عبر مزوّد دفع معتمد، وتُطبّق العمولة المتفق عليها تلقائيًا.
6. منع الالتفاف وملكية العملاء
- يُحظر توجيه عميل سغارطون للدفع خارج المنصّة لتجنّب العمولة.
- المدّة: أثناء الاستخدام ولمدة 12 شهرًا بعد التوقّف.
- في حال الالتفاف، يحقّ لسغارطون المطالبة بـالعمولة التعاقدية وإنهاء الحساب.
7. الصيغ والأسعار والعروض
- يجوز لسغارطون تقديم صيغ (جلسة، باقة، اشتراك) وعروض دون خفض صافي المعالج عن السعر المتفق بعد العمولة.
- يلتزم المعالج بعدم عرض أسعار خارج المنصّة تهدف للإضرار بالمنصّة.
8. الجودة والانضباط والتسجيل
- الالتزام بالمواعيد ومعايير الجودة وبيئة مناسبة واتصال مستقر وكاميرا/ميكروفون يعملان.
- التسجيل ممنوع دون موافقة خطية من جميع الأطراف.
- الإلغاء المتأخر/عدم الحضور المتكرّر: خفض ترتيب، تعليق أو إنهاء.
8 مكرر. الآراء والترتيب والظهور
- يمكن للأولياء التقييم/التعليق؛ ويجوز لسغارطون الإشراف (محتوى مخالف، آراء مزيفة).
- يتأثّر الترتيب بعوامل متعددة (الجودة، الآراء، عدم الحضور، سرعة الرد) وقد تُعدّله سغارطون وفق تقديرها.
- لا ضمان للظهور أو عدد العملاء.
9. الفوترة والتحويل والاحتياطي
- التحويل: خلال 7 أيام عمل بعد تنفيذ الجلسة.
- حد أدنى للتحويل: يجوز تجميع المدفوعات حتى حد أدنى (مثل 50 دينار).
- احتياطي أمان: حتى 10% لمدة 30 يومًا لتغطية الاسترجاعات/الاعتراضات البنكية.
- المقاصة: يجوز لسغارطون المقاصة بين المبالغ المستحقة للمعالج وأي مبالغ واجبة عليه.
9 مكرر. الاسترجاعات والنزاعات والاعتراضات البنكية
- إذا كان الاسترجاع بسبب المعالج (إلغاء متأخر/عدم حضور)، يُخصم من التحويلات اللاحقة.
- عند الاعتراض البنكي يُمكن تجميد الحساب؛ ويجوز لسغارطون الطعن وفرض رسوم معالجة إذا كان غير مبرّر.
9 ثالثًا. الالتزام والتأمين
- يتعهّد المعالج بحيازة الترخيص اللازم وتأمين المسؤولية المهنية ساريًا.
- الالتزام بالقوانين (حماية الطفل، البلاغات الإلزامية، أخلاقيات المهنة).
- المعالج مسؤول عن الضرائب والرسوم الاجتماعية.
10. البيانات والخصوصية واتفاق المعالجة الخفيف
- تتصرّف الأطراف كـمسؤولين مستقلّين عن المعالجة لأغراضهم.
- قد تستخدم سغارطون معالِجين فرعيين معتمدين؛ أمان مناسب؛ إشعار بالحوادث خلال 72 ساعة عند الاقتضاء.
- وفق سياسة الخصوصية وسياسة الكوكيز.
- عند الإنهاء، يمكن طلب تصدير البيانات؛ ثم الحذف وفق القانون.
11. التعليق والإنهاء
- التعليق بسبب عدم السداد أو الاحتيال أو الإساءة أو الالتفاف أو المخالفات المتكرّرة.
- الإنهاء بعد إشعار غير مُعالج؛ الآثار حسب البند 12 ثالثًا.
12. حدود المسؤولية والتعويض
- تُحدّد مسؤولية سغارطون بـالرسوم/العمولات المدفوعة من المعالج خلال آخر 6 أشهر.
- يلتزم المعالج بـتعويض سغارطون عن أي مطالبات من الغير تتعلق بخدماته.
12 ثالثًا. آثار الإنهاء
- تُستكمل الجلسات المحجوزة أو تُسترجع حسب سياسة الأولياء؛ وقد تُحجز/تُقاصّ المبالغ المقابلة.
- تصدير البيانات عند الطلب؛ ثم الحذف (وفق الاحتفاظ القانوني). تبقى **منع الالتفاف** لمدة 12 شهرًا.
13. القوة القاهرة
لا تتحمّل سغارطون المسؤولية في حالات القوة القاهرة (انقطاعات الشبكة، الكوارث…). ويمكن إعادة جدولة الجلسات.
13 مكرر. الدعم واتفاقية زمن الاستجابة
- الدعم داخل التطبيق أو عبر support@sghartoon.com.
- زمن الاستجابة المستهدف: يومان عمل. الأدلّة: سجلات النظام (الحجوزات، الاتصالات، الأرصدة).
14. التعديل والقانون الواجب التطبيق
- يجوز تعديل الشروط بإشعار 30 يومًا (داخل التطبيق/البريد). يُعدّ الاستعمال المستمر قبولًا.
- القانون التونسي — محاكم تونس.
بيانات مستخدمي Google
تستخدم تطبيق Sghartoon للمعالجين بعض خدمات Google لتمكين المصادقة الآمنة، وعند تفعيل الخيار من قبل المستخدم، مزامنة الجلسات مع تقويم Google.
البيانات التي يتم الوصول إليها
- عنوان البريد الإلكتروني المرتبط بحساب Google
- الاسم الكامل المرتبط بحساب Google
- المعرّف الفريد لحساب Google
- بيانات تقويم Google (فقط في حال تفعيل مزامنة التقويم من قبل المستخدم)
كيفية استخدام البيانات
- تنفيذ المصادقة الآمنة عبر Google Sign-In
- تحديد هوية حساب المعالج داخل المنصة
- المزامنة الاختيارية لجلسات العلاج مع تقويم Google
تخزين البيانات وحمايتها
يتم تخزين البيانات بشكل آمن باستخدام إجراءات تقنية وتنظيمية مناسبة، ولا يُسمح بالوصول إليها إلا للخدمات المخوّلة والضرورية لتشغيل التطبيق.
مشاركة البيانات
لا يتم بيع أو تأجير أو مشاركة بيانات مستخدمي Google مع أي أطراف ثالثة لأغراض إعلانية أو تجارية.
مدة الاحتفاظ بالبيانات
يتم الاحتفاظ بالبيانات طالما أن حساب المستخدم نشط. ويمكن للمستخدم طلب حذف بياناته في أي وقت.
الامتثال لسياسات Google
